ABS PROTECTION GMBH as the operator of this web presence takes the protection of your personal data very seriously. Therefore, the legal data privacy regulations are observed. Your personal information will be treated as confidential and will be collected and used only within the limits of the legal data privacy regulations in keeping with the following Data Privacy Statement.

In the course of the further development of our website and the implementation of new technologies, changes to this Data Privacy Statement may be required. Therefore we recommend to occasionally reread this Data Privacy Statement.


Collection, processing and use of data

In connection with a mere visit to our website and/or our online shop no personal data will be collected or saved. Their use under these conditions is therefore basically possible without providing any personal information.


Use of cookies, Google Analytics and Facebook plug-ins


However, in order to improve our web presence, especially in order to make it more efficient, more secure and more user-friendly, and for the implementation of the order process, we use what is called "session cookies" and "regional cookies". These are basically harmless little text files that will be saved in your browser and/or on your computer and that automatically expire when the browser is closed or after two hours of inactivity (session cookies), or after 30 days at the latest (regional cookies). This saves the respective path visited on our website as well as the region - the country from which access to our web presence takes place - in an anonymous way. However, these anonymized access data do not enable us to arrive at any conclusion with respect to your person.

Google Analytics

In addition, Google Analytics, a web analysis service by Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043 USA) is used. Google Analytics also applies so-called "cookies", which, again, are text files that are saved on your computer and that allow analysis of your use of our website. The information thus generated about your use of this web presence is as a rule transmitted to servers of Google Inc. in the U.S. and saved. By activation of the IP anonymization within the framework of our website, your IP address is, however, truncated beforehand within European Union member states or within other contracting states under the Treaty on the European Economic Area. Only in exceptional cases will the entire IP address be transmitted to a server of Google Inc. in the U.S. and shortened there. On our behalf, Google information thus obtained to evaluate your use of our web presence, to compile website activity and thus, ultimately, to provide further services to us for the aforementioned purposes.

You may inhibit the saving of cookies by selecting the appropriate settings in your browser software. With respect to this we point out, however, that in this event possibly not all of the functions of our website may be fully usable to you.

In addition, you may exercise your right to object to this collection of your usage data by downloading and installing the "deactivation add-on" offered by Google Inc. on your computer. Facebook-Plugins / "Like-Button" 

Our web presence includes integrated plug-ins of the social network "Facebook" (http://www.facebook.com, Facebook Inc., 1601 Willow Road, Menlo Park, California, 94025, USA and/or http://de-de.facebook.com, Facebook Ireland Limited, Hanover Reach, 5-7 Hanover Quay, Dublin 2 Ireland). Facebook plug-ins are identifiable by the Facebook logo and/or by the so-called "Like" button on our website.

When you visit our website, a direct connection between your browser and a Facebook server is established via the plug-in, whereby Facebook will receive the information that you have visited our web presence with your IP address. If you click on the Facebook "Like" button while you are logged into your account at Facebook, you will be enabled to link content of our website in your Facebook timeline or your Facebook profile. Thus, Facebook will be able to associate and/or connect your visit to our website with your Facebook account.

Collection and use of personal data

If you accept our privacy policy, you will give us the opportunity of collecting and using your data as follows:

On our web presence personal data will be collected and saved, as far as this is necessary upon opening a customer account, within the scope of the order process or when registering for our newsletter or for other services requiring registration, and thus for the establishment, the execution or the modification of the associated legal relationship between you and ABS PROTECTION GMBH. This is, however, as a matter of principle done on a voluntary basis and only to the respective extent required, provided you let us know the relevant data.

In addition, ABS will save your personal data for any product recalls and other customer information in connection with the safety of ABS products. ABS will inform you in this event or in case of other safety-relevant conditions in connection with ABS products by e-mail, letter or telephone.

This applies, for example, to your first and last names, your address data along with any possibly different delivery address, your mobile phone number (mandatory for ordering the ABS Care Program (service package)), your e-mail address and, if applicable, the serial number of your existing ABS backpack.

If you voluntarily register your e-mail address for our newsletter, we will use this address also for our own promotional purposes and also for the transmission of our partners' offers. As a matter of principle, you can however unsubscribe from our newsletter at any time using the link contained in the respective e-mail. If you have ordered our ABS Care Program (service package) you will, however, still at any rate receive the e-mails required for its implementation, in particular a reminder of the delivery of the activation unit as well as a reminder of the end of the contract and on options of prolonging it.

If you register for our extended warranty, your data will be used by us for examining and handling of warranty cases as well as for internal evaluation purposes.

We point out that payment details and bank connections when placing orders in the online shop for Germany and Austria will be collected and saved exclusively by our processing partner Shopatron, and in case you order the ABS Care Program (service package), exclusively by our processing partner Wirecard. In these cases, only the data privacy statements of Shopatron and/or Wirecard shall be relevant.

Your personal data will be passed on to third parties without your express consent only if this is indispensable for the respective implementation of the contract or if we are required to do so by law or for other reasons as mentioned below. Any further propagation and/or sale of your data will not take place.

A disclosure of personal data will occur in particular in the following cases:

  • in the case of an order, to the respective forwarding contractor for effecting delivery (only such data as are required for this purpose))
  • in case of an order of the ABS Care Program (service package), in order to ensure the insurance cover, to Roland Schutzbrief-Versicherung AG (insurance company) as well as upon ordering the ABS Care Program (service package) in Belgium, France, Luxembourg, the Netherlands, or Spain, to our contract partner NIC Impex, who is in charge of shipping the activation unit to you there
  • in the case of chargeable orders, to our payment service provider Wirecard for processing of the payment
  • in the event of payment default or other perturbations of the contractual relationship between you and ABS PROTECTION GMBH, the data required to enforce our respective rights and/or claims, to our legal counselor for prosecution
  • in the case of personal data of users of the backpacks from our ABS Inside partners, the data will be passed on to the partner in the event of a product recall action or of safety instructions by the respective partner whose backpack you own, so that this partner may inform you about the recall action or the safety instructions.

Within the scope of such a disclosure, the respectively commissioned service providers may use the passed-on data solely for the particular purpose of the contract.

We point out that, for legal reasons, personal data for the processing of orders will be saved for up to ten years. In this case, the data will not be deleted. Instead of deletion, the data will be blocked.

We point out that despite all precautions and safety provisions, data transfer over the internet (e.g. in communication via e-mail) can contain security gaps. Complete protection of data against access by third parties unfortunately is not possible and therefore cannot be guaranteed by us either.


Objection and right to information

You have the right to obtain information about your personal data saved by us at any time without giving reasons. In addition, you can revoke at any time the consent given to us on collecting and using data and may have your data saved by us blocked, corrected or deleted. Third party use of our own data

We explicitly reserve the right to legal action in case of unsolicited sending of advertising and/or other informational material, especially in the case of sending spam e-mails.
